Definitions
“Company,” “Clinic,” “we,” “us,” or “our” refers to Georgia GoDrive Traffic School LLC.
“You,” “user,” or “student” refers to any individual accessing this Site or enrolling in a state-approved defensive driving course.
“Services” refers to all defensive driving or driver improvement programs offered by the Clinic. Georgia DDS-certified defensive driving or driver improvement courses; and Non-state-approved private informational or refresher courses (e.g., FastPass programs)
Non-State-Approved Educational Courses (FastPass Program)
The Clinic may offer certain educational or refresher-style courses that are not certified, approved, or regulated by the Georgia Department of Driver Services (DDS) or any governmental authority.
These courses include, but are not limited to:
1-Hour FastPass Drivers Class ($24.99)
By enrolling in any non-state-approved course, you expressly acknowledge and agree that:
- The course is for informational and educational purposes only
- The course does NOT satisfy any court order, legal requirement, or probation condition
- The course is NOT approved by DDS
- The course does NOT qualify for:
- License point reduction
- License reinstatement requirements
- Court-mandated defensive driving
- Insurance premium reductions under O.C.G.A. § 33-9-42
- The issued FastPass Certificate is NOT a state-certified certificate and may not be accepted by:
- Courts
- Insurance providers
- Employers
- Government agencies
You are solely responsible for verifying whether any course meets your specific legal or administrative needs prior to enrollment of service.
Eligibility
You must be at least eighteen (18) years of age, or a parent/legal guardian must enroll and sign the Student Contract on behalf of a minor.
Certified courses are approved for Georgia use only. It is your responsibility to confirm eligibility before enrolling. You understand that in order to get an insurance discount, you must first verify that your insurance company will accept the DDS Certified Course or Georgia GoDrive FastPass Online Certificate for any course.
Binding Student Contract
Enrollment in any course requires execution of the official Georgia DDS-mandated Student Contract.
The Student Contract governs:
- Course duration and completion requirements
- Attendance rules
- Rescheduling and forfeiture conditions
- Conduct standards
- Dismissal and breach provisions
- Grievance procedures
- Limitation of liability
In the event of any conflict, refer to the signed Student Contract.
Online Registration & Electronic Signature
By registering online, you agree that:
- All information provided is accurate and complete.
- Your electronic signature is legally binding under Georgia law.
- Enrollment is not final until full payment is received and the Student Contract is executed.
Providing false information may result in immediate rejection and may be barred without refund.
Payments
- Full payment is required to reserve a seat.
- All required course instruction must be completed within sixty (60) calendar days of the original enrollment date.
- Failure to complete within sixty (60) days voids enrollment and requires full re-registration with payment.
We do not save full credit card numbers.
Fraudulent chargebacks or payment disputes may result in denial of services and collection action as permitted by Georgia law.
Refunds & Rescheduling
Refunds and rescheduling are governed by the Student Contract and published Refund Policy.
Key conditions include:
- No refunds for late arrival, partial attendance, no-show, or dismissal.
- Cancellation or transfer requires at least one (1) full hour notice prior to class start time.
- No partial credit, prorated refunds, or temporary certificates are issued.
- All coursework must be completed within sixty (60) days of original enrollment.
Attendance & Remote Requirements
Students must:
- Arrive on time and remain for the entire session.
- Attend sober and free from impairing substances.
- Follow instructor directions and DDS regulations.
For remote classes:
- Students must remain visible on camera at all times.
- Failure to remain on camera constitutes non-attendance and may result in dismissal without refund.
Dismissal & Breach
Violation of Clinic rules, including but not limited to:
- Cheating
- Falsification of information
- Disruptive conduct
- Failure to comply with remote attendance requirements
constitutes breach of contract and may result in immediate dismissal without refund.
No Guarantee of Third-Party Acceptance
The Clinic does not guarantee that any course whether state-certified or non-state-approved will be accepted by any court, insurance company, probation office, employer, or government agency.
Non-state approved courses, including the FastPass program, are not intended for any official or legal use and are provided strictly for voluntary educational purposes.
You are solely responsible for confirming eligibility and acceptance prior to enrollment.
Instructional Monitoring & Recording
Course sessions may be monitored and/or recorded for attendance verification, compliance, grading review, security, and regulatory recordkeeping purposes.
Force Majeure
The Clinic is not liable for delays or cancellation due to events beyond its reasonable control, including severe weather, natural disasters, government orders, public health emergencies, or technical failures.
In such cases, courses may be rescheduled or refunded at the Clinic’s discretion.
Disclaimer of Warranties
The Site and Services are provided “as is” and “as available.”
We make no guarantee that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of Liability
To the maximum extent permitted by Georgia law:
- The Clinic’s total liability shall not exceed the tuition paid.
- We are not liable for indirect, incidental, or consequential damages, including loss of income, license suspension consequences, insurance outcomes, or court penalties.
- We are not responsible for a student’s failure to obtain reinstatement, points reduction, insurance discounts, or other third-party benefits.
Student Grievance & Appeal Procedure
To maintain compliance and ensure fairness, all disputes must follow the formal administrative process outlined below.
1. Scope of Grievances
This procedure applies to disputes regarding:
- Attendance records
- Examination scores
- Course dismissal
- Certificate issuance
2. Submission Requirements
All grievances must:
- Be submitted in writing using Form GGDTS 1053
- Be received within seven (7) business days of the course date
- Include:
- Student’s full legal name
- Contract number
- Certified instructor on duty
- Course date
- Detailed explanation of the dispute
- Requested resolution
Incomplete submissions may delay review.
3. Administrative Review Process
Upon receipt of a complete grievance, the Clinic will conduct an internal administrative investigation.
The review may include examination of:
- Attendance logs
- Examination records
- Instructor notes
- Video recordings (remote and in-person classes)
- All relevant documentation
4. Written Determination
A written response will be issued within ten (10) business days of receipt of a complete grievance submission.
5. Final Determination
The decision of the Clinic Owner or designated Agent shall be final.
Internal administrative review is required before any external action.
6. Certificate Hold
No certificate will be issued while a grievance is under review.
Intellectual Property
All content, materials, and features displayed on or made available through this website (the “Site”), including but not limited to text, course content, instructional materials, graphics, logos, design elements, layout, colors, images, audio, video, downloads, software, and overall appearance, are the exclusive property of Georgia GoDrive Traffic School LLC or its licensors and are protected under applicable United States copyright, trademark, trade dress, and other intellectual property laws.
The business name “Georgia GoDrive Traffic School,” associated logos, service names, slogans, and branding elements are proprietary to Georgia GoDrive Traffic School LLC and are protected under applicable law trademark and service mark rights.
No portion of the Site may be copied, reproduced, modified, distributed, transmitted, displayed, published, sold, licensed, or otherwise exploited for commercial purposes without the prior written consent of Georgia GoDrive Traffic School LLC, except as expressly permitted by law.
Unauthorized use of the Site or its content may result in civil liability and, where applicable, criminal penalties under federal and state law.
All rights not expressly granted herein are reserved.
Third-Party Services
We may use third-party providers for payment processing, analytics, advertising, scheduling, and website hosting.
We are not responsible for the content or policies of third-party platforms.
Privacy
Your use of the Site is governed by our Privacy Policy, which is incorporated by reference.
Governing Law & Venue
These Terms and the Student Contract are governed by the laws of the State of Georgia.
Venue for any permitted legal action shall be in the courts of Habersham County, Georgia.
Changes to Terms
We may update these Terms at any time. Continued use of the Site constitutes acceptance of any revised Terms.
